TOPTEL LLC TERMS & CONDITIONS
By submitting this form, requesting pricing, or proceeding with TOPTEL LLC (“TOPTEL”), the Customer acknowledges and agrees to the following:
1. Scope of Work
TOPTEL will perform only the work and services included in the applicable approved proposal, Scope of Work, agreement, plans, and project documents. Work not expressly included is excluded unless authorized in writing.
2. Pricing & Changes
Pricing may be based on available plans, project information, site conditions, and subcontractor or supplier pricing. Additional work, owner-requested changes, upgrades, concealed conditions, or work outside the approved scope may result in additional costs and schedule adjustments. Changes must be authorized in writing.
3. Project Schedule
Project schedules are estimates and may be affected by permitting, inspections, weather, material availability, site conditions, design changes, owner decisions, subcontractors, utilities, governmental requirements, or other circumstances beyond TOPTEL’s reasonable control.
4. Customer Responsibilities
Customer shall provide accurate information, timely decisions, required approvals, property access, and documents necessary for the project. Delays caused by the Customer or third parties may affect project cost and schedule.
5. Permits & Approvals
Where included in the project scope, TOPTEL may coordinate permits, inspections, and approvals. TOPTEL does not guarantee governmental, zoning, permitting, inspection, financing, or third-party approvals.
6. Existing & Concealed Conditions
Existing conditions may differ from available plans or information. Concealed, unknown, or unforeseen conditions discovered during the work may require additional work, cost, or schedule adjustments.
7. Payments
Customer agrees to make all payments in accordance with the applicable proposal, agreement, invoice, payment schedule, or other approved project terms. Failure to make required payments may result in suspension or delay of work and other remedies permitted by the applicable agreement and law.
8. Design & Professional Services
Architectural, engineering, surveying, consulting, or other professional services are limited to the applicable approved scope and may be subject to separate agreements and professional requirements.
9. Warranty
Any TOPTEL warranty is limited to the terms expressly stated in the applicable executed agreement or warranty document. Manufacturer and third-party warranties are subject to their respective terms.
10. No Contract by Submission
Submission of this form does not by itself create a construction contract or authorize TOPTEL to begin work. Construction or other services will begin only after the applicable agreement, scope, pricing, and required approvals have been accepted and executed.
11. Governing Documents
These Terms & Conditions apply together with the applicable executed agreement and project documents. If a conflict exists, the applicable executed agreement shall control.
