Development Items to Consider

  1. Zoning of the Project:

    • Verify the zoning, and do not rely solely on what the realtor says.
  2. Flood Zone:

    • Is a topographic survey available?
  3. Legal Plat:

    • Ensure a legal plat is available (note: a plat is not the same as a survey).
  4. Planned Unit Development (PUD):

    • If the project is in a PUD, be aware that stricter rules may apply in addition to base zoning regulations.
  5. Re-Zoning Requirements:

    • If re-zoning is necessary, check if City staff will support the re-zone. They often provide early feedback.
    • Example: A planner in Celina once informed me over the phone that their City Manager “doesn’t want any more apartments in the City”—and the project was stopped immediately. While rare, such situations can happen.
  6. Easements:

    • Ensure easements are shown on an official survey. Some surveys may only show boundaries and omit other critical details.
    • Understand that there is no law requiring a survey to include everything, so it’s possible to receive an incomplete or useless survey.
  7. Right-of-Way (R.O.W.) Taking:

    • Check if the City has plans to take part of your property for road expansion. This is a common occurrence.
